There certainly is. The provincial registry doesn't check foreign trademarks. So registering "Celtic Knot" just means they don't have another brewery, or probably anything in retail, with that name, in NB and possibly the Maritimes. You can still get sued by somebody anywhere else in the world if they think there's a chance that you'll infringe on their marks. You can even get sued by people who registered their marks after you - and potentially lose if they actually used their mark first.mr x wrote:Isn't there more to it than that? I registered it as Celtic Knot Brewing. I don't plan to expand to a mega brewery, I just want to offer more locally made beer is all. Hopefully I can fly under the radar. If not then meh, I'll change the name.

It may not seem like much now, but what happens down the road if both businesses grow and become successful? Somebody is going to lose their branding and intellectual identity that they built. That's a huge mistake. Massive.

I don't think there are international limitations. Doesn't seem to be when thinking of the Budweiser/McDonald's/Bear Republic/Anchor Brewing/etc. lawsuits.

I met with my local town council this evening. It was a little intimidating as I had to stand on a podium in front of everyone while they drilled me questions. LOL. Anyways, after about 45 mins or so, it was over and they officially approved a nano brewery out of my home. While I'm very happy, still lots of other hurdles to overcome. But still, it's one' step out of the way.

Yeah, Patrice's local municipality wouldn't let him brew out of his home. He had a petition against him as well with people all worried about rat infestation, beer getting into the town water, etc.akr71 wrote:![]()

I think I recall Patrice saying that was a Moncton bylaw thing, not a NB thing. I don't remember, my attention was more focused on his berliner weisse at the timeakr71 wrote:![]()

That's correct, it was just a Moncton municipal thing. Next door in Riverview, Bruce got approved out of his house.....so it just depends on the local bylaws. The plan is just to supply a couple of local establishments. I've got three places in mind, with two pretty much a guarantee.
