I've already stated in an another post that I think the Olands are being jerks, and simply using the word "moose" (even in relation to beer) shouldn't be enough for trademark infringement and someone with deep pockets should challenge it. So... I'm just going to leave this here. Root beer. Draw your own conclusions.

Moosehead Breweries suing over Moose Wizz root beer logo

Beer giant alleges Adirondack Pub & Brewery Inc.'s moose head label 'highly similar,' may cause confusion

Moosehead Breweries Limited is suing a pub in upstate New York for alleged trademark infringement and unfair competition over its non-alcoholic root beer logo.

Adirondack Pub & Brewery Inc., in Lake George, N.Y., currently makes Moose Wizz, and markets the drink in a bottle featuring the head of a cartoon-like moose with a toothy grin.

In a lawsuit filed with the U.S. District Court earlier this month, the Saint John-based beer-making giant says the soft drink's logo is "highly similar" and may cause "irreparable damage and injury" to its brand.

But Adirondack Pub & Brewery founder John Carr rejects that claim.

"I'm a little like the moose, I'm a pretty independent guy and that didn't ring well with me," Carr told CBC News.

"The Moosehead Brewery, they don't make soda, they don't market anything in our area, there's been no confusion in the marketplace whatsoever with these products," he said.


Moosehead Breweries alleges the soft drink Moose Wizz may cause "irreparable damage and injury" to its brand. (Moosehead Breweries)

​No one from Moosehead was immediately available for comment.

Moosehead's lawyers have requested a jury trial and damages, including all the profit made from Moose Wizz.

Late last year, Moosehead convinced a micro-brewery in Sudbury, Ont., to drop the word "moose" from the name of its Imperial IPA Angry Moose and India Pale Ale Friendly Moose products.

Shawn Mailloux, the owner of Stack Brewing, said Andrew Oland, the president of Moosehead Breweries, had called him to say Moosehead has the sole rights to the word "moose" when it comes to beer in Canada.

Moosehead says its case against Adirondack Pub & Brewery dates back to 2008 when Carr attempted to trademark the Moose Wizz name, then abandoned his application when faced with opposition from Moosehead, based on its prior use of the Moose family of trademarks.

"Moosehead has used the Moosehead mark since at least 1931 in connection with ale, beer, stout, porter and lager," the court documents state.

"Moosehead's Moose family of marks include marks which include the term 'Moose' and/or the likeness of the head of a moose."

The company contends Adirondack Pub and Brewery's Moose Wizz logo is so similar, "members of the purchasing public familiar with Moosehead's products and Moosehead's Moosehead trademarks are likely to be confused, misled or deceived into thinking that the products of Defendant are products of Moosehead or are in some way sponsored by or connected with Moosehead, to Moosehead's irreparable damage and injury.

"Moosehead has no control over the nature and quality of the products offered by Defendant under the Moose Wizz trademark, and thus will be damaged and irreparably harmed by reason of the loss of control over its reputation and the erosion of its goodwill in the Moosehead Registered Marks," the documents state.

Yup, it's fucking ridiculous. They must think their customers are idiots if they are concerned that their customers will confuse their beer with a damn soda pop. Next they'll be suing Java Moose (which is a coffee roaster) in Saint John as well. :finger:

Maybe it's just me, but I really don't find them similar at all, other than both of them have a picture of a Moose on the label.

To me they are very similar, a moose head pointed the same way overlapping an arced border with a red banner at the bottom and curled edges. I think the issue is that in addition to making rootbeer this brewery makes a whole line of craft beer. It would be like a microbrewery selling a "Red Bull Whizz IPA" it wouldn't be on the market a day before red bull sued them even though no one is going to accidentaly buy a red bull whizz IPA thinking it is a non alcoholic energy drink red bull would be protecting their brand by doing this. I can tell you i would take a moose whizz root beer over any mass produced moosehead crap but i'm just saying they definitely have just cause for concern here, whether it merits a lawsuit is up to their board of directors but this situation would be handled the same way by any macro brewery out there.

Also - considering both labels have a moose and nothing else on the label they have everything in common lol

Randy has been growing hops in NS for 10 (15? 20?) years, so I think he knows something about them.

Ange and I had a good meeting with the DC folks today, and have another short one tomorrow. Our part will be an intro to beer, and we'll give the same talk a few times to a new crowd that shuffles through the theatre each 20-30 minutes. Have ideas on how to present the different ingredients and methods, in an interesting, a little bit geeky, way. However, if folks have ideas on topics they'd like to see covered, we'll see if there's time to incorporate them. We were ambitious with five demos and tasting/smelling/observing different experiments, but I don't know if the logistics of the quick turn-around and big groups will allow for all of our ideas. My idea to set up a reflux distillation and look at hop oil (inspired by checking out wortly's lab) was shot down. :)

Randy Lawrence has been growing hops in the Annapolis Valley since 1985.

The farmer, businessman and brewmaster extraordinaire has given hops cuttings to his neighbours for decades in an effort to spark a local hop revival.

"I’ve been trying to get people growing hops for years now," Lawrence, the owner of Sea Level Brewing Co. in Port Williams, Kings County, said Tuesday of the small, green flower used to give beer its bitter flavour.

I think he's a great candidate for the job, I've spoken with Randy quite a few times and he is very knowledgeable and passionate about hops. Does he put the most hops in his beer...no; does his beer have diacetyl...more often than not in my experience but neither of those things have anything to do with his knowledge of hops.

Haha I honestly had no idea, as my only interaction with randy regarding hops has been drinking his beer. Where, like you say, he doesn't use the most hops. But if he's got the knowledge, great!
